Terms of Service.
These terms govern your use of montoyacreative.co and the services of Montoya Creative Co. (“the Studio,” “we,” “us”), a Virginia-based real estate media studio. By requesting a booking, using the client portal, or engaging our services, you agree to them.
Services & bookings
Requests submitted through this site are inquiries, not confirmed bookings. A shoot is confirmed only when the Studio accepts it — you’ll receive a written confirmation. Estimates shown while building a request are indicative and may be adjusted for property specifics, travel, or scope changes before confirmation.
You are responsible for ensuring the property is ready at the scheduled time and that we have permission to access and photograph it. Weather-dependent work (such as twilight or aerial coverage) may be rescheduled for conditions or airspace restrictions; we’ll coordinate promptly when that happens.
Payment & delivery
Deliverables are provided through the client portal. Until an invoice is settled, downloads may remain locked and media may display watermarks. Full-resolution files are released on payment. Rush timelines, added scope, or additional deliverables may carry additional fees agreed before the work is done.
Media licensing
All photographs and films remain the intellectual property of Montoya Creative Co. Delivered media is licensed — not sold — under the licensing agreement presented in the client portal at the time of download, which controls how media may be used (typically: marketing of the listed property and the client’s own business promotion). Media may not be resold, sublicensed, or transferred to third parties (including MLS-adjacent syndicators beyond normal listing use) without written permission. The Studio may use delivered work in its own portfolio and marketing unless agreed otherwise in writing.
Property marketing pages
Shareable property pages we host are provided as a courtesy alongside delivery and may be updated or retired over time. Details shown there (beds, baths, price, MLS numbers) are supplied by the client, and the client is responsible for their accuracy and for compliance with applicable listing and advertising rules.
Cancellations
Life happens. Cancel or reschedule with reasonable notice and we’ll work with you. Late cancellations or on-site turn-aways may incur a fee reflecting reserved time and travel.
Liability
To the fullest extent permitted by law, the Studio’s total liability for any claim arising from the services is limited to the amount paid for the shoot in question. We are not liable for indirect or consequential damages, or for delays caused by events beyond our reasonable control. Nothing here limits liability that cannot lawfully be limited.
The portal
Portal accounts are personal to your business; keep credentials confidential. We may suspend access that compromises the platform or other clients’ media.
Changes
We may update these terms from time to time; the date above reflects the current version. Material changes will be reflected here before they take effect.
